TERMS OF SALE
1. GENERAL
These Terms of Sale set out the basic terms and conditions applicable to the sale of products through the GiftHome online store.
The GiftHome website and online store are operated by GHC TEKSTİL GIDA PAZ. DAN. VE E-TİC. LTD. ŞTİ.
By placing an order through GiftHome, you agree to these Terms of Sale, without prejudice to any mandatory consumer rights available to you under applicable law.

3. PRODUCTS
GiftHome primarily offers handcrafted chess sets, backgammon sets, decorative products, personalized products, and related accessories.
The main characteristics of each product are described on the relevant product page.
Because certain products are handmade and made from natural materials, slight variations may occur in wood grain, color tones, surface textures, handcrafted details, and similar characteristics. Such variations may form part of the natural and handcrafted character of the product.
We take reasonable care to display product images as accurately as possible. However, product colors and appearance may vary slightly depending on screen, device, lighting, and display settings.
4. ORDERS AND FORMATION OF THE CONTRACT
Placing an order through GiftHome constitutes an offer by the customer to purchase the relevant products.
After an order is placed, order information may be sent to the customer electronically.
An order becomes final once the required payment process has been successfully completed and the order has been accepted by GiftHome.
GiftHome reserves the right to refuse or cancel an order where there is a stock error, payment issue, obvious pricing error, suspected fraudulent or unauthorized transaction, or another legitimate reason arising under applicable law.
If GiftHome cancels an order for which payment has already been received, the amount collected will be refunded to the customer through an appropriate payment method.
The customer is responsible for reviewing the products, quantities, personalization options, delivery address, and other order details before completing the order.
5. PRICES AND PAYMENT
Unless expressly stated otherwise, the applicable price for a product is the price displayed in the online store at the time the order is placed.
Available payment methods will be displayed to the customer during checkout.
GiftHome reserves the right to change product prices and promotions for future orders. Unless otherwise required by applicable law, price changes made after an order has been completed will not affect the price of that completed order.
The customer confirms that the information provided during payment is accurate and that they are authorized to use the selected payment method.
6. TAXES, CUSTOMS DUTIES AND IMPORT CHARGES
International orders may be subject to customs duties, import taxes, VAT, or other governmental charges depending on the destination country.
Whether these charges are collected by GiftHome during checkout or are payable by the customer upon delivery may vary depending on the destination country and the delivery method used.
Where required by applicable law, relevant charges or information regarding the possible application of such charges will be provided to the customer before the order is completed.
7. SHIPPING AND DELIVERY
Order processing times, estimated delivery times, and available delivery options are described in the Shipping & Delivery section of our website.
Unless expressly stated to be guaranteed, delivery times are estimates.
Delivery times may be affected by shipping carriers, customs procedures, government authorities, natural disasters, strikes, or other events outside GiftHome's reasonable control.
If a significant delay or delivery issue is identified, GiftHome will make reasonable efforts to contact the customer.
Any mandatory consumer rights relating to delivery remain unaffected.
8. 14-DAY RETURN AND WITHDRAWAL RIGHT
Subject to applicable exceptions, customers may request a return within 14 days of receiving the product.
To be eligible for a return, the product must be in the same condition in which it was received, unused and undamaged, with all parts and accessories complete and, where reasonably possible, in its original packaging.
To initiate a return, the customer must contact GiftHome at ergunatalay@gifthome.com.tr.
Products should not be returned before the return request has been approved by GiftHome and the necessary shipping instructions have been provided.
Any mandatory rights of withdrawal and return available under applicable consumer law remain unaffected.
9. RETURN SHIPPING COSTS
For eligible returns made within the 14-day return period, GiftHome will cover the standard return shipping cost, provided that the return method and shipping instructions specified by GiftHome are followed.
The customer must contact GiftHome before returning the product and follow the return instructions provided.
Express, additional, or other supplementary shipping costs resulting from returns made without GiftHome's prior approval or using a method other than the one specified by GiftHome may not be covered.
10. PERSONALIZED AND CUSTOM-MADE PRODUCTS
Products made according to the customer's specifications, including products personalized with a name, date, message, logo, image, or other personal detail, may be excluded from the standard right of withdrawal and return to the extent permitted by applicable law.
However, if a personalized or custom-made product is delivered defective, damaged, incomplete, or with personalization that differs from what was ordered, the customer's rights under applicable law remain unaffected.
11. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS
Customers are encouraged to inspect products within a reasonable period after delivery.
If a product arrives damaged or defective, contains missing parts, or differs from the product ordered, the customer should contact GiftHome as soon as possible at ergunatalay@gifthome.com.tr.
To assess the issue, the customer may be asked to provide photographs or other information relating to the product, packaging, and shipping package.
The customer's mandatory legal rights regarding defective or non-conforming products remain unaffected.
12. REFUNDS
Once the returned product has been received and inspected by GiftHome, the customer will be informed of the outcome of the return.
If the return is approved, the refund will be issued within 10 business days, where reasonably possible, to the original payment method used for the order.
Additional time may be required for the bank, credit card issuer, or payment service provider to reflect the refund in the customer's account.

13. MANDATORY CONSUMER RIGHTS
Nothing in these Terms of Sale excludes or limits any rights granted to consumers under applicable law that cannot legally be excluded or restricted by contract.
Because GiftHome sells products to customers in different countries, mandatory consumer protection provisions applicable in the customer's country may also apply.
14. EUROPEAN UNION CUSTOMERS
Consumers in the European Union generally have a 14-day right of withdrawal for products purchased online, subject to applicable consumer protection laws.
Certain products, including goods made to the customer's specifications or clearly personalized products, may be excluded from this right of withdrawal where permitted under applicable law.
Mandatory consumer rights relating to defective or non-conforming products remain applicable independently of the right of withdrawal.

If there is any conflict between these Terms of Sale and mandatory consumer law, the applicable mandatory consumer protection provisions will prevail.
16. GOVERNING LAW
These Terms of Sale are governed by the laws of the Republic of Türkiye, subject to applicable conflict-of-law rules and mandatory consumer protection provisions.
This choice of law does not deprive consumers of any mandatory consumer protection rights available under the laws of their country of residence that cannot legally be excluded by agreement.
Any rights available to consumers under applicable law regarding competent courts, dispute resolution, and other legal remedies remain unaffected.
